This week Lex Machina   reached a significant state court analytics milestone with the addition of the 100th state court. Lex Machina .launched as a patent litigation analytics project out of Stanford. in 2008 . Since acquisition by LexisNexis, it was expanded to cover business litigation in all federal trial courts. The company took on the challenges of taming the  disparate and unruly world of state court litigation. with the inaugural state court launch of Delaware Chancery in 2018. T

Valuable New Tranche of Corporate Litigation. The reached the 100 state court mark recently with the addition of litigation analytics for Suffolk County Supreme Court and Westchester County Supreme Court (the “New York Courts”) and Oklahoma County District Court (the “Oklahoma Court”).  They previously launched the five counties within the boundaries of New York City (New York, Kings, Queens, Richmond and the Bronx) in 2020. As a former New Yorker I am astonished that it took four years to reach these two suburban boroughs.  These counties are home to some major corporate players. Westchester is home to companies much as Mastercard, Pepsi, IBM and Regeneron. Suffolk is home to the likes of Canon USA, Estee Lauder, Lenovo and Nikon USA – not to mention the Hampton’s “gold coast.” This is a valuable new data tranche.

Today Lex Machina, a LexisNexis company, is releasing a new tool for competitive insights called “Litigation Footprint.”  Lex Machina now includes litigation analytics from over 27 million cases filed in 94 federal district courts and over 1,300 state courts in 34 states and the District of Columbia.  The Litigation Footprint enhancement was developed in response to customer demand for deeper party level analysis tools.

Since its launch in 2010 as a platform for analyzing IP litigation, Lex Machina has continuously raised the bar for the legal analytics market. The Lex Machina platform combines natural language processing, machine learning, human curation, data normalization and extensive tagging of data elements to improve precision and granularity of research results and reporting.

.Litigation Footprint focuses on the litigation histories of corporate entities in order to enable lawyers to quickly get a high level overview of a  party’s litigation footprint across the United States.

Lex Machina and LexisNexis announced today that it has officially released a Chapter 11 Bankruptcy Module, which provides Legal Analytics for over 115,000 Chapter 11 proceedings. It’s been a long time coming. Ever since they launched their Bankruptcy Appeals  Analytics  in 2017, customers have be wondering when Chapter 11 analytics would launch. Hooray! That day is here.

Excellent timing given the fragile state of the economy. Recessions has historically been a boon for Bankruptcy and Finance practices. The Chapter 11 Bankruptcy Module includes the entire docket in any bankruptcy proceeding filed after 2009 in a United States Bankruptcy Court under Chapter 11 of the Bankruptcy Code. Like other Lex Machina modules, the Chapter 11 Bankruptcy Module provides insights into judges, courts, debtors, creditors, creditor committees, and trustees involved in Chapter 11 proceedings over the last 13 years.

Lex Machina, a LexisNexis company,  released  a new legal analytics tool “State Motion Metrics”. State Motion Metrics provides insights which can be used to develop a motion strategy or identify the best arguments in state motion practice. State Motion Metrics is available for four Delaware state courts, including the Delaware Court of Chancery. Motion metrics are also available for the Los Angeles County Superior Court. Lex Machina plans to roll out State Motion Metrics in more courts later this year.

Lex Machina  pioneered the introduction of interactive litigation analytics for the law firms with the launch of the Intellectual Property product in  end uses. It launched as a project at Stanford Law School. Now a LexisNexis product, they offer  one of the most sophisticated analytics products in the legal market and  cover all types of federal, They are also expanding their coverage of state litigation.

Here are some key findings

  • W.D, Tex., D Del., and E.D, Tex. have the highest number of patent filings in 2021

  • Patent case filings are consolidating more into the top three courts, from 47% in 2019 to 57% in 2021.

  • Federal PTAB appellate case filings fell 40% between 2020 and 2021.

  • 23% of federal PTAB appellate cases that terminated from 2019 to 2021 were ultimately reversed.

  • 34% of federal patent appellate cases that terminated from 2019 to 2021 were ultimately reversed.

  • Samsung, Google, Apple, Microsoft and Amazon  were the most active patent defendants in 2021.

  • WSOU Investments LLC ( a patent monetization company) was the most active plaintiff in patent litigation last year.

  • Judge Albright was assigned to 23% of all patent cases filed in 2021.

  • Fish & Richardson top the list of defendant firms representing 669 defendants in  38 districts between 2019 and 2021.

Lex Machina has launched a new module of Legal Analytics for federal courts of appeal (“Appellate Analytics”). The module adds nearly 400,000 circuit court cases from across all 13 federal circuits. Until now the majority of federal analytics products have covered  trial courts — federal district courts. Litigators will be excited to learn that there is finally a source for federal appellate analytics.

In a prior post  I reported  survey results on products to be purchased in 2020 and 2021… which included a fairly broad spectrum of products. Lex Machina and LexisNexis is announcing the release of the seventh California county: Orange County Superior Court. Los Angeles County Superior Court, Sacramento County Superior Court, San Diego County Superior Court, Riverside County Superior Court, San Bernardino County Superior Court, Alameda County Superior Court.

These counties are key courts for civil cases involving contracts, torts, employment, and other civil matters, and serve more than 24 million citizens.  Like other Lex Machina products, the California modules are created using Lex Machina’s machine learning, natural language processing  and human review to extract  and validate data-driven insights from millions of state court documents. According to the press release legal analytics are now available for any Superior Court civil trial case filed in any of these seven California courts.

Today LexisNexis is announcing the launch of Lexis+ Litigation Analytics. Litigation Analytics does two things. It integrates analytics into the research and practical guidance  workflow.  Lexis+  now offers “enhanced analytics” from Lex Machina as well as state level analytics derived from CourtLink for the states that Lex Machina does not currently cover.
Karl Harris, C.E.O. of Lex Machina a offered me a demonstration of Lexis + Litigation Analytics.. Harris placed analytics within the context of the new workflow which was introduced with Lexis+.  Lexis+ includes a persistent navigation bar which today adds litigation analytics to the 3 original  pillars of,  Lexis + : workflow: research, practical guidance and brief analysis. The Lexis + home page  is designed around an inviting query “What would you like to research today”  hovering over a large search box.  Analytics are still fairly new to the average  lawyer’s toolkit and I think it is wise to remind lawyers about analytics throughout Lexis+ workflow experience..
Harris explained that the core goals of the Lexis+ enhancement was based on customer feedback which highlighted the importance of   accuracy confidence and efficiency in analytics products. In addition they wanted to  deliver an integrated product experience in what Lexis refers to as the Lexis+ ecosystem.
